Privacy Policy

§ 1

Introduction

This Privacy Policy (“Policy”) describes how Latent Ape, LLC (“Latent Ape,” “we,” “us,” or “our”) collects, uses, stores, shares, and otherwise processes personal information in connection with our websites, SaaS platforms, iOS applications, and any other products or services that link to this Policy (collectively, the “Services”).

By accessing or using any of the Services you acknowledge that you have read and understood this Policy. If you do not agree, please do not use the Services.

§ 2

Information we collect

2.1 — Information you provide

  • Account data. Name, email address, username, password, and profile details when you create an account.
  • Payment data. Billing address and payment method details processed by our third-party payment processors (Stripe, Apple In-App Purchase). We do not store full card numbers.
  • User content. Any text, images, files, prompts, feedback, messages, or other materials you create, upload, submit, or transmit through the Services.
  • Communications. Information you provide when you contact us, respond to surveys, or participate in promotions.
  • Support data. Diagnostic information, crash logs, and other details you share when reporting issues.

2.2 — Information collected automatically

  • Device & browser data. Hardware model, operating system and version, unique device identifiers (IDFV), browser type, language, and time zone.
  • Usage data. Pages and screens viewed, features used, actions taken, session duration, frequency, interaction patterns, referring URLs, and in-app navigation paths.
  • Performance data. Crash reports, response times, errors, and diagnostic telemetry.
  • Network data. IP address, ISP, and approximate geolocation (city/region level) derived from IP.
  • Cookies & similar technologies. We use cookies, local storage, and pixel tags to maintain sessions, remember preferences, and measure usage. See Section 8.

2.3 — Information from third parties

We may receive information from analytics providers, advertising partners, identity verification services, public databases, data brokers, and social media platforms if you choose to link a third-party account.

§ 3

How we use your information

We use the information we collect for any purpose consistent with this Policy and applicable law, including:

  • Providing, maintaining, and improving the Services.
  • Personalizing your experience and delivering tailored content and recommendations.
  • Processing transactions and sending related notices.
  • Communicating with you about products, features, offers, promotions, and events (you may opt out of marketing).
  • Monitoring, analyzing, and measuring usage trends, engagement, and effectiveness of the Services.
  • Research, development, and training of artificial intelligence and machine learning models — including using de-identified, aggregated, or anonymized data derived from your use of the Services to train, improve, validate, and create AI/ML models, algorithms, and features, both within and across our products.
  • Generating aggregated, de-identified, or anonymous datasets that we may use or share for any lawful purpose without restriction.
  • Detecting, preventing, and addressing fraud, abuse, security incidents, and technical issues.
  • Enforcing our Terms of Use, protecting our rights and property, and complying with legal obligations.
  • Any other purpose disclosed to you at the time of collection or with your consent.
§ 4

How we share information

We may share personal information in the following circumstances:

  • Service providers & processors. Third parties that perform services on our behalf (hosting, analytics, payment processing, customer support, AI/ML processing, email delivery).
  • Affiliates & subsidiaries. Current and future entities under common ownership or control with Latent Ape, for purposes consistent with this Policy.
  • Business transfers. In connection with any merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction, your information may be transferred as a business asset.
  • Legal & safety. When we believe disclosure is necessary to comply with law, regulation, legal process, or governmental request; to enforce our agreements; or to protect the rights, safety, or property of Latent Ape, our users, or the public.
  • With your consent. When you direct us to share information with a third party.
  • Aggregated or de-identified data. We may share data that has been aggregated or de-identified so that it cannot reasonably be used to identify you, without restriction.

We do not sell your personal information as defined by the California Consumer Privacy Act. We do not share your personal information for cross-context behavioral advertising.

§ 5

Data retention

We retain personal information for as long as your account is active, as reasonably necessary to provide the Services, and as required to comply with legal obligations, resolve disputes, and enforce our agreements. De-identified, aggregated, or anonymized data — including data already incorporated into trained models — may be retained indefinitely.

When personal information is no longer required, we will delete or anonymize it in accordance with our internal retention schedules, unless a longer retention period is required or permitted by law.

§ 6

Your rights & choices

6.1 — Account & content

You may update or correct your account information at any time through the applicable Service settings. You may request deletion of your account by contacting us at privacy@latentape.com or through in-app account management. Upon account deletion, we will delete or anonymize your personal information within 30 days, except where retention is required by law or legitimate business purpose (e.g., fraud prevention, audit records). De-identified data already incorporated into trained models or aggregated datasets is not subject to deletion.

6.2 — Marketing opt-out

You may unsubscribe from promotional emails by clicking the “unsubscribe” link in any such email. You may also manage push notification preferences in your device settings. We may still send transactional or service-related messages.

6.3 — Cookies

Most browsers allow you to refuse or delete cookies. Please note that disabling cookies may impair the functionality of the Services.

6.4 — California residents (CCPA/CPRA)

If you are a California resident, you have the right to: (a) know what personal information we collect, use, and disclose; (b) request deletion of your personal information; (c) opt out of the “sale” or “sharing” of personal information (we do not sell or share for cross-context behavioral advertising); and (d) not be discriminated against for exercising your rights. 6.5 — EEA, UK & international users

If you are located in the European Economic Area, UK, or another jurisdiction with applicable data protection laws, you may have additional rights including access, rectification, erasure, data portability, restriction of processing, and the right to object. Our legal bases for processing are: performance of a contract, legitimate interests (product improvement, security, analytics, AI/ML development), compliance with legal obligations, and your consent where applicable. § 7

Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security. You use the Services at your own risk.

§ 8

Cookies & tracking technologies

We and our third-party partners use cookies, web beacons, pixels, local storage, and similar technologies to collect information automatically. These technologies help us authenticate users, remember preferences, analyze traffic, measure campaign effectiveness, and deliver relevant content.

Analytics. We use analytics services (which may include Google Analytics, Mixpanel, or similar providers) that use cookies and similar technologies to collect and analyze usage information.

§ 9

Children’s privacy

The Services are not directed to children under the age of 13 (or under 16 in the EEA/UK). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without parental consent, we will take steps to delete it promptly. If you believe a child has provided us with personal information, please contact us at privacy@latentape.com.

§ 10

International data transfers

We are based in the United States. Your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction. By using the Services, you consent to the transfer of your information to the United States and other jurisdictions as described in this Policy.

§ 11

Apple App Store & iOS-specific disclosures

For our iOS applications distributed through the Apple App Store, the following additional terms apply:

  • We use the Identifier for Vendors (IDFV) for analytics and fraud prevention. We do not use the Identifier for Advertisers (IDFA) unless we first obtain your consent through Apple’s App Tracking Transparency framework.
  • You may manage location, camera, microphone, photo library, and other permissions through your iOS device Settings at any time.
  • Any in-app purchases or subscriptions are processed by Apple. Apple’s privacy policy governs their processing of your payment information.
  • Account deletion is available through in-app settings or by contacting privacy@latentape.com, in compliance with Apple’s App Store Review Guidelines.
§ 12

Changes to this Policy

We may update this Policy from time to time. When we make material changes, we will notify you by updating the “Last updated” date above and, where required by law, providing additional notice (such as an in-app notification or email). Your continued use of the Services after the updated Policy becomes effective constitutes your acceptance of the changes.
